Welcome! This Privacy Policy (“Privacy Policy”) explains how ZeptoLab UK Limited ("ZeptoLab" or "we") collects, uses, and shares your personal information while you play ZeptoLab Games in Apple Arcade (“Games”). This Privacy Policy only applies to such Games. Apple’s privacy policies and terms of services also apply, and ZeptoLab is not responsible for Apple’s terms, policies, or procedures.

We may make changes to this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we will update the Last Updated date above.

By accessing our Games, you accept our Privacy Policy and Terms of Use, and you consent to our collection, storage, use and disclosure of your information as described in this Privacy Policy.

1. Personal Information ZeptoLab collects.

We aim to minimize how much personal information we collect from users when they play the Games. We will collect the following; (i) your Apple Game Center ID, (ii) your progress in the Games, and (iii) information about your play activity for the Purpose defined below. We are not able to identify you with your Apple Game Center ID, even if it is paired with other data we have about you. Apple provides us with non-identifiable data to help us improve the Games. If you do not want us to collect this information, then you must opt out of sending analytics to Apple and/or play the Games in offline mode.

2. Children's personal information.

Protecting the privacy of children is of the utmost important to us and we do our best to meet both EU and U.S. standards. The Games have been designed to be family friendly and to be suitable for use by children.

If you set your age as underage, we will not collect analytics.

We do not knowingly collect children's personal information without parental consent, except as permitted under applicable laws such as the U.S. Children's Online Privacy Protection Act (COPPA) and the EU General Data Protection Regulation (GDPR). If you are a parent of a child playing the Games, you may review or have your child's personal information deleted and refuse the further collection of their personal information by contacting us at privacy@zeptolab.com. You may also contact us at privacy@zeptolab.com if you believe we are collecting a child's personal information in violation of COPPA or the GDPR and we will delete this information as quickly as possible.

If we want to change how we use personal information collected from children, we will first notify you by either posting an update on the Websites and/or the Games and you will be required to review, sign, and send to ZeptoLab a consent form to approve how we will use your child's personal information.

3. Do third parties have access to my personal information?

ZeptoLab does not disclose to third parties any data relating to the Games.

4. Sharing your personal information for business/legal reasons.

A. Business Transfers. As we continue to develop our business, we may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third-parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of our assets are acquired or we merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that we reserve the right to transfer any information collected from you in the case of any such transfer. In such event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

B. Legal. We may disclose information you provide to respond to subpoenas, court orders, requests from authorities, and other legal process, and to establish/exercise our legal rights. We may also disclose your information to defend against legal claims when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may share your information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.

5. How long will ZeptoLab keep my personal information?

How long we store your personal information will depend on the purpose that we originally collected it. We will not retain personal information for longer than is necessary for our business or for legal requirements.

As long as a player has an active Game Center account, their data is stored in Apple’s iCloud system. This stored data ensures that players can continue playing the Games where they most recently stopped playing and is used for no other purpose than to ensure the functioning of the Games. However, we will delete any personal information stored on our servers if you have not launched the respective Game in two (2) years.

Please note that if you store information locally on your wireless device and/or in the iCloud then information may remain there. If you would like to delete your information from your wireless device or iCloud, please follow the instructions provided by your wireless device provider or Apple.

6. Declining or withdrawing permission for data and data subject rights.

Players may decline to store Game Center data in iCloud or to send data to Game Center. To turn off iCloud data storage, they must turn off iCloud in Apple Settings for our Games. To stop sending data to Game Center, they must sign out of Game Center in Apple Settings. As a result, they will not appear on leaderboards and it will also disable the Games’ synchronization across devices.

A. For California Consumers.

If you are a California resident and we have collected personal information (as defined in the California Consumer Privacy Act) about you, then, starting January 1, 2020, you may also request that we:

  • Provide you the categories of personal information we collect and disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties with whom we share personal information. Such information is also set forth in this Policy.
  • Provide access to and/or a copy of certain information we hold about you.
  • Delete certain information we have about you. /li>

You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights.

If you would like further information regarding your legal rights under applicable law or would like to exercise any of them, please contact us as described in the “Contact Us” section below. We will consider all requests and respond within the time period stated by applicable law. Please note your rights and choices vary depending upon your location, and that we may request you provide us with information necessary to confirm your identity before responding to your request as required or permitted by applicable law. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Games to you or to comply with a legal obligation. If you ask us to delete certain information, you may no longer be able to access or use the Games.

B. For Nevada Consumers.

Under a Nevada privacy law, certain Nevada residents may opt out of the “sale” (as defined in that law) of certain categories of information about them for monetary consideration to a person for that person to license or sell such information to additional persons. As of the effective date of this Privacy Policy, we do not engage in such “sales” of information covered by that law. However, if you are a qualifying Nevada resident, you may submit a request to opt out of future “sales” by us under that Nevada law by writing to us as described below. We reserve the right to take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.

7. Is my personal information secure?

The security of your personal information is important to us. We follow generally accepted industry standards to protect your information, both during transmission and once it is received. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. While no security system is completely secure, we and our Service Provider stake appropriate security measures to protect against unauthorized access or disclosure of the information collected by us. For ZeptoLab, this includes, but is not limited to, ensuring that all of your information is disclosed only on a "need to know" basis and ensuring that all information collected by ZeptoLab is done so via secured connections and protected and encrypted (using secure socket layer technology, "SSL") by industrial grade security software to guard against unauthorized access.

Any login credentials to your wireless device or Apple Arcade subscription, such as a username or password, are important security features. Therefore, it is your responsibility to protect such credentials. Do not share your password with any third parties. If your password has been compromised for any reason, you should change it immediately.
